If you fall in a retail store or supermarket you always want to report the accident. Even if you do not think you are injured. Many times, people do not experience pain until a day or two after the accident. Hopefully, you are fine, but if not, having a report will be an important part of proving your claim.
The report will typically document the location, time, and cause of the fall. It also puts the store on notice, so they can pull any video surveillance of the area of the fall. Often the video surveillance is the single most important piece of evidence in these types of cases. If store fails to keep the video this can also be strong evidence in your favor. But if you don’t report the accident, they will have a legitimate reason for not having the video.
Once you compose yourself after the fall it is important to get photos of the area. Not just close ups of the condition that caused your fall, but the surrounding area as well. Sometimes when the store employee takes a report, they do not adequately describe the condition, or they may say they did not see anything on the floor. A picture is worth a thousand words. Once you have a photo there is little they can say to minimize the nature of the condition.
It’s important to know that just because you fall in a store does not make the store responsible. You need to probe the store created the condition or they should have known about the condition in time to correct it.
